By transacting with Pack It N Stack It and renting any equipment, you agree to the following terms and conditions:
- Delivery: Pack It N Stack It will deliver rental equipment to the address provided. You must permit our employees or agents to enter the property for delivery and pickup. This entry will not be considered trespassing, and any claims of trespass are waived. All equipment must be returned directly to Pack It N Stack It.
- Additional Costs: Additional costs may apply for delivery and pickup. Please refer to our website for details on costs, including transportation and replacement. By renting, you acknowledge and agree to these costs.
- Acknowledgment and Maintenance: You acknowledge receiving the equipment in good condition and agree to inspect it immediately. Report any defects within 12 hours. You must return the equipment in good condition, except for normal wear and tear. Damage beyond normal wear and tear will incur additional charges.
- Injury Waiver: You agree that Pack It N Stack It is not liable for any injuries or damage related to the use of our equipment. You waive any claims of injury or property damage resulting from the use of the equipment.
- Prohibited Conduct: You may not sublease or permit others to use the equipment. Children and pets should not access the equipment.
- Indemnification: You agree to indemnify and hold Pack It N Stack It, its officers, agents, and employees harmless from any claims, damages, or costs arising from your use of the rental equipment, including legal fees.
- Cancellation Policy: A cancellation fee of up to 50% of the order price may apply if you cancel within 48 hours of the scheduled delivery.
- Privacy: We will not share your personal information with any third parties. We comply with the Protection of Personal Information Act to keep your information secure.
- Entire Agreement: This Rental Agreement and our website constitute the full agreement. Any changes must be in writing and signed by both parties. Time is of the essence.
- Attorney Fees and Collection Fees: If legal action is required to enforce this agreement, Pack It N Stack It is entitled to recover attorney fees and costs. Any legal action will be filed in the Circuit Court of Peoria County.
- Limitation of Liability: Pack It N Stack It’s liability is limited to the amount paid for the rental equipment in the calendar year of the breach or injury. We are not liable for more than this amount.
- No Warranties: Equipment is rented on an “AS IS” basis, without any warranties of merchantability or fitness for a particular purpose.
- Understanding of Terms: You warrant that you have read and understood these terms and conditions before renting any equipment. If any part of this Agreement is invalidated, the remaining terms will remain in effect.
